1. Acceptance of Terms

By accessing and using the services provided by 9th Island AI ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

9th Island AI provides artificial intelligence solutions including but not limited to:

  • AI Receptionist services
  • Custom AI solutions
  • Predictive analytics
  • Business automation services
  • Related consulting and support services

3. Use of Services

3.1 Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms to use our services.

3.2 Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our services in any way that violates applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Use our services to compete with us or develop competing products

4. Account Registration

Some services may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

5. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by 9th Island AI and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

6. Payment Terms

6.1 Subscription Billing

Our services are billed on a monthly recurring subscription basis:

  • Billing Cycle: Monthly, charged on the same day each month
  • Payment Methods: Credit card, debit card, or other approved payment methods
  • Auto-Renewal: Your subscription automatically renews each month unless cancelled
  • Failed Payments: If payment fails, we will attempt to charge again. Service may be suspended after 3 failed attempts.
  • Setup Fees: Currently waived for all plans during our promotional period
  • Taxes: You are responsible for any applicable sales tax, VAT, or other taxes

6.2 Pricing Changes

We reserve the right to change our pricing with 30 days' advance notice. Current subscribers will be notified via email before any price changes take effect.

6.3 Overage Charges

If you exceed your plan's monthly call limit, overage charges will apply. We will notify you when you approach your limit and provide options to upgrade your plan.

7. Service Availability

We strive to provide reliable services but do not guarantee:

  • Uninterrupted or error-free service
  • That our services will meet all your requirements
  • That defects will be corrected

We reserve the right to modify, suspend, or discontinue any part of our services at any time.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our services are provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless 9th Island AI from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

10. Cancellation and Termination

10.1 Cancellation by Customer

You may cancel your subscription at any time with the following terms:

  • Notice Period: 30-day advance notice required for cancellation
  • Month-to-Month: All plans are month-to-month with no long-term contracts
  • How to Cancel: Submit cancellation request via email to lee@9thislandai.com or through your account dashboard
  • Final Billing: You will be billed for the full 30-day notice period
  • No Refunds: Monthly fees are non-refundable. Cancellation takes effect at the end of your current billing cycle.
  • Data Export: You may request export of your call recordings and data within 30 days of cancellation

10.2 Termination by 9th Island AI

We may terminate or suspend your access to our services immediately, without prior notice, for:

  • Breach of these Terms of Service
  • Non-payment or failed payment attempts
  • Fraudulent activity or misuse of services
  • Violation of applicable laws

Upon termination by us for cause, your right to use our services will cease immediately without refund.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 9th Island AI operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.
